By using our Services, you represent and warrant that you are not a resident of any state with comprehensive privacy laws that grant consumers specific rights regarding their personal information. If you are a resident of any such state, you must immediately cease using our Services.

We reserve the right to verify your state of residence and to terminate your account immediately if we discover that you are a resident of an excluded state. No refunds will be provided for accounts terminated due to residency in an excluded state.

1. Acceptance and Scope

1.1 Agreement to Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree with this Privacy Policy, you must not use our Services. Your continued use of the Services following any changes to this Privacy Policy constitutes your acceptance of such changes.

1.2 Applicable Jurisdiction

This Privacy Policy is designed to comply with federal privacy laws and the privacy laws of states that do not have comprehensive consumer privacy legislation. We do not tailor our data practices to comply with state-specific privacy laws beyond what is required by federal law. Users in states with comprehensive privacy regulations are prohibited from using our Services as stated above.

2. Information We Collect

2.1 Business and Account Information

We collect information that you provide directly to us when you create an account or use our Services. This includes your business name, address, contact details, tax-identification numbers, billing information, payment-card details, and any other information you voluntarily provide. We also collect operational data such as employee counts, service areas, and usage metrics.

2.2 Customer Information

Through your use of our Services, you may upload information about your end customers, including their names, addresses, contact information, service preferences, payment methods, and service history. You represent and warrant that you have obtained all necessary consents from your customers to upload and process their information through our Services.

2.3 Usage and Technical Data

We automatically collect technical information when you use our Services, including IP address, browser type, device identifiers, operating system, pages visited, time spent on pages, and links clicked. This data helps us understand how our Services are used and identify areas for improvement.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Platform
  • Process transactions and send related information
  • Send administrative information, including changes to terms and policies
  • Respond to comments, questions, and provide customer service
  • Send marketing and promotional communications (with your consent)
  • Monitor and analyze usage and trends to improve user experience
  • Detect, investigate, and prevent fraudulent transactions and other illegal activities
  • Comply with legal obligations

4. How We Share Your Information

We may share your information in the following circumstances:

  • With Service Providers: End Customer information is shared with their designated Service Provider.
  • With Third-Party Service Providers: We share information with vendors who perform services on our behalf (e.g. Stripe for payments, Clerk for auth, Twilio for SMS).
  • For Legal Reasons: We may disclose information if required by law or to protect our rights.
  • Business Transfers: Information may be transferred in connection with a merger, acquisition, or sale of assets.
  • With Your Consent: We may share information for any other purpose with your consent.

5. SMS / Text Messaging Communications

Mowzey may send transactional SMS text messages to End Customers on behalf of the lawn-care businesses (Service Providers) that hire them. These messages support the delivery of the lawn-care service the End Customer is contracting for.

Types of messages we send

  • Customer onboarding invitations: a single link the Service Provider sends so the End Customer can complete account setup, add a payment method, and review their service plan.
  • Service notifications: messages confirming that a scheduled visit has been completed at the End Customer's property.
  • Quote and billing notifications: when a Service Provider sends an ad-hoc quote (e.g. for landscaping or one-off work), the End Customer may receive a link to review and accept the quote.

We do not send marketing or promotional SMS through this channel. All messages are transactional and tied to a specific service the End Customer has engaged.

Consent and opt-in

End Customers provide their phone number directly to the Service Provider (the lawn-care business) at the time of intake — typically in person, over the phone, or through the Service Provider's own intake form. By providing that phone number for the purpose of service, the End Customer authorizes the Service Provider (and Mowzey acting on the Service Provider's behalf) to send transactional SMS related to the requested service. Service Providers are contractually required, under our Terms and Conditions, to confirm consent has been obtained before adding any End Customer to the platform.

Opt-out and help

End Customers may opt out of SMS at any time:

  • Reply STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) to any SMS to stop further messages from that Service Provider.
  • Reply HELP to receive customer support information.
  • Contact the Service Provider directly (their business name and phone number appear in each message).

Message frequency

Frequency varies with each End Customer's service schedule. A typical recurring lawn-care subscription generates 1–4 messages per month (visit confirmations + occasional billing receipts). One-time quotes generate at most 1–2 messages per quote.

Rates

Message and data rates may apply, charged by the End Customer's mobile carrier. Mowzey does not charge End Customers for SMS.

Mobile information sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information processed by Mowzey exclude mobile opt-in data and consent. This information will not be shared with any third parties for promotional purposes. We share phone numbers only with the service providers strictly necessary to deliver each message (Twilio for SMS transit; Clerk for authentication; Stripe for payment receipts) — and only as required to fulfill the End Customer's transactional request.

6. Data Security

We implement appropriate technical and organizational security measures to protect your information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure.

7. Data Retention

We retain your information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. When we no longer need your information, we will securely delete or anonymize it.

8. Children's Privacy

Our Platform is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete that information promptly.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. Your continued use of the Platform after any changes constitutes acceptance of the updated policy.
